What Exactly is Conveyancing?

Think of conveyancing as the legal detective work and paperwork that makes your home purchase official. It starts once your offer is accepted and finishes when you get the keys. It's all about ensuring you're buying what you think you're buying, with no nasty surprises lurking in the legal small print.


Step 1: Instructing Your Solicitor

The very first thing you'll do is appoint a solicitor or licensed conveyancer. This is a crucial decision. At Town and City Homes, we always recommend choosing someone proactive and communicative. They'll be your legal guide, so pick someone you trust. Once instructed, they'll send you a client care letter and terms of engagement to sign, along with a request for funds for initial searches.


Step 2: The Legal Nitty Gritty – Draft Contracts and Enquiries

Your solicitor will receive the draft contract pack from the seller's solicitor. This pack contains important documents like the draft contract, title deeds, and property information forms. Your solicitor will then pore over these documents, raising enquiries with the seller's solicitor about anything unclear or concerning. This could be anything from boundary disputes to planning permissions or rights of way. It's like a legal Q&A session to ensure everything is above board.


Step 3: Searches, Searches, and More Searches!

While enquiries are ongoing, your solicitor will order various searches. These are vital for uncovering potential issues that aren't immediately obvious. Common searches include:
  • Local Authority Search: Reveals planning permissions, building control issues, and road schemes affecting the property.
  • Environmental Search: Checks for contaminated land, flood risk, and other environmental factors.

Step 5: Exchange of Contracts

Once all enquiries are satisfied, searches are back and clear, and your mortgage offer is firmly in place, you're ready for exchange of contracts. This is a big moment! You and the seller will sign identical contracts, and your solicitor will exchange them with the seller's solicitor. At this point, you'll typically pay your deposit (usually 10% of the purchase price), and the sale becomes legally binding. A completion date is also set.


Step 6: Pre-Completion and Completion!

Between exchange and completion, your solicitor will carry out final checks, arrange for the transfer of funds, and prepare the Transfer Deed. On the completion day, the remaining balance of the purchase price is transferred from your solicitor to the seller's solicitor.
